Accurately identifying the state of the art is the fundamental step in determining the novelty and inventive step of a patent. However, the definition of \u201cstate of the art\u201d is not harmonized between the European Patent Convention and U.S. law. <\/p>\n

We will therefore examine which documents actually constitute the prior art in the two jurisdictions, what the significant exclusions are, what role inventors and third parties play, and other aspects that help define the precise scope of the prior art as it pertains to the EPO and the USPTO.<\/p>\n

A few notes about the speaker,<\/strong> our member Paolo Provvisionato<\/strong>:<\/p>\n

Paolo Provvisionato earned his degree in mechanical engineering from the University of Bologna in 1988 with a thesis on artificial intelligence applied to gear design. After working for a time as a designer and developer at an IT company, he transitioned to a career as an intellectual property consultant, training at a leading intellectual property firm in Turin. After obtaining his qualifications as an Italian and European patent, trademark, and design agent, he established his own practice in Bologna in 1996, providing industrial property consulting services to both Italian and international clients. He has been appointed as a court-appointed technical expert in numerous cases before the Courts of Bologna and Ancona. <\/p>\n

He has always been passionate about documentary research, which he has incorporated into his work as an agent, and is regularly invited to participate in meetings of the SACEPO-PDI and PDG Working Group IMPACT.<\/p>\n
